Landmark Bail Order Secured in Section 309 IPC Case | Advocate Sourav Singh Tomar’s Effective Representation Before MP High Court

On 8th April 2024, the Hon’ble High Court of Madhya Pradesh at Gwalior granted bail to the applicant in MCRC No. 13217/2024, where the accused was charged under Section 309 of the Indian Penal Code for attempted suicide. The case involved sensitive and emotional dimensions, where the applicant was allegedly involved in a self-harm incident and subsequently subjected to custodial proceedings. Representing the applicant, Advocate Sourav Singh Tomar skillfully argued the case, highlighting both the legal and humanitarian considerations involved.

During the hearing, Advocate Tomar effectively presented that the applicant was suffering from emotional and mental distress and had no prior criminal record. He further contended that continued incarceration would serve no purpose, especially after the filing of the charge sheet, and instead advocated for the applicant’s rehabilitation and lawful protection. Citing the latest jurisprudence on the decriminalization of mental health struggles and referencing the rights of the accused under Article 21 of the Constitution of India, he persuaded the Court to grant bail.

The Hon’ble Court, after considering the submissions and facts of the case, allowed the application and directed that the applicant be released on bail with appropriate conditions. This progressive order reflects not only the Court’s sensitivity but also the strategic and compassionate advocacy led by Sourav Singh Tomar, who continues to earn a reputation for defending fundamental rights with depth and professionalism.
