Fourth Bail Application Allowed in Attempt to Murder Case

In a major relief for the applicant Dalveer Singh Kansana, the Hon’ble High Court of Madhya Pradesh, Bench at Gwalior, granted bail in MCRC No. 41492 of 2021 on 23rd August 2021. The case, registered under Sections 307, 323, 294, 506, 147, and 148 of IPC, involved allegations of armed assault with an intent to kill. This was the fourth bail application filed on behalf of the applicant, and previous applications had either been dismissed on merits or withdrawn with liberty to revive after crucial eyewitnesses were examined.

Appearing for the applicant, Advocate Sourav Singh Tomar, along with Advocate Ankur Maheshwari, presented a strong case demonstrating the weaknesses in the prosecution’s version. Advocate Tomar highlighted that the complainant (PW-1) had turned hostile and that the other eyewitnesses (PW-2 and PW-3) had been declared “not traceable” by the trial court. He further argued that the nature of injuries was simple, that the FIR was lodged with mala fide intention, and the applicant had already remained in custody since April 2021 without the need for further custodial interrogation.

The Hon’ble Court, after considering the submissions and circumstances, allowed the bail application, directing the applicant’s release upon furnishing a bond of ₹50,000 with two solvent sureties. Strict conditions were imposed to ensure cooperation during trial and compliance with COVID-19 safety measures. The Court also noted that the delay in arrest and inconsistencies in evidence raised doubts about the prosecution story.
