Criminal Proceedings Quashed in Matrimonial Dispute

In a significant legal victory, Advocate Sourav Singh Tomar successfully secured the quashing of criminal proceedings under Sections 498A, 506, and 34 of the Indian Penal Code along with Section 4 of the Dowry Prohibition Act, on behalf of the petitioners in MCRC No. 5745 of 2024. The case, registered as Crime No. 60/2019 at Police Station Mahila Thana, Gwalior, stemmed from a matrimonial dispute that had since been amicably resolved between the parties.

Advocate Tomar filed a petition under Section 482 of the CrPC before the Hon’ble High Court of Madhya Pradesh, Bench at Gwalior, seeking quashing of the FIR and the related proceedings, including the order dated 09.10.2023 passed by the learned JMFC in Case No. 1287 of 2019. Along with the petition, joint compromise applications were submitted, affirming that the dispute was settled voluntarily, without coercion or pressure. The Principal Registrar of the Court verified the compromise and submitted a favorable report.

Citing authoritative Supreme Court judgments including Gian SinghB.S. JoshiManoj Sharma, and others, Advocate Tomar argued that when a dispute is private in nature—especially arising out of matrimonial and family issues—the High Court can exercise its inherent powers under Section 482 CrPC to quash criminal proceedings even in non-compoundable offences. The Hon’ble Court accepted the legal position and held that continuing the prosecution would serve no useful purpose and would amount to an abuse of the judicial process.

Accordingly, the Hon’ble Court quashed the FIR and all consequential proceedings, bringing an end to a long-standing matrimonial litigation. This case highlights Advocate Sourav Singh Tomar’s strategic use of jurisprudence and procedural law to secure relief for his clients in complex matrimonial and criminal matters.
