On 27th June 2023, the Hon’ble High Court of Madhya Pradesh at Gwalior granted bail to Rajat, the applicant in MCRC No. 24818 of 2023, who was facing prosecution in a serious matter under Sections 294, 323, 506, 34 of the Indian Penal Code and Section 25(1-B)(A) of the Arms Act. The case, registered at Police Station Gole Ka Mandir, Gwalior, involved allegations of assault, abuse, and illegal possession of a firearm—charges that carry significant legal and custodial implications.
Representing the applicant, Advocate Sourav Singh Tomar presented a strong case before the Hon’ble Court, asserting that the applicant had been falsely implicated and that the firearm recovery was not credible. He argued that the case was riddled with procedural lapses and lacked substantial evidence to justify prolonged pre-trial incarceration. Advocate Tomar also pointed out that the incident arose out of a personal dispute, and there was no serious threat to public order or safety.
Taking note of the facts, circumstances, and legal submissions, the Hon’ble Court was pleased to grant bail, observing that custodial interrogation was not necessary and that the applicant would cooperate with the investigation and trial. Bail was granted on furnishing a personal bond and surety to the satisfaction of the concerned trial court.
