Bail Granted in Robbery Case Under Section 394 IPC

In a significant ruling dated 16th October 2023, the Hon’ble High Court of Madhya Pradesh at Gwalior granted bail to Hemant Rajpoot, a 20-year-old student, in MCRC No. 43743 of 2023. The applicant had been in judicial custody since 14.08.2023 in connection with Crime No. 238/2023 registered at Police Station Dharnavada, District Guna, under Section 394 of the Indian Penal Code. The prosecution had alleged that the applicant, along with a co-accused, had committed a robbery by assaulting the victim with an iron rod and fleeing with his purse and mobile phone.

Appearing for the applicant, Advocate Sourav Singh Tomar put forth a compelling argument emphasizing the applicant’s youth, his status as a college student, and the adverse impact of continued incarceration on his education. Advocate Tomar also pointed out that the recovery had already been made, the trial would take considerable time to conclude, and the applicant posed no risk of absconding or tampering with evidence. Importantly, while the State raised concerns about two previous cases, it was clarified that bail had already been granted in those matters and none involved offences of a similar nature.

After hearing both parties and considering the overall circumstances, including the applicant’s young age, the Hon’ble Justice Sanjeev S. Kalgaonkar was pleased to grant bail, setting a personal bond of ₹50,000 with one solvent surety. The Court imposed conditions to ensure the applicant’s cooperation with the trial and safeguard the integrity of the judicial process.
