In a significant ruling by the Hon’ble High Court of Madhya Pradesh at Gwalior dated 21st October 2024, Advocate Sourav Singh Tomar, appearing along with Advocate Raj Kumar Shrivastava, successfully secured bail for their client Pahalwan, who was charged under serious provisions of the Bharatiya Nyaya Sanhita (BNS), 2023. The case, arising from Crime No. 134/2024 registered at Police Station Maksudangarh, District Guna, involved allegations under Sections 132, 221, 191(2), 191(3), 190, 324(3), and 324(4) of BNS. This was the applicant’s second bail application under Section 483 of BNSS, filed after the first one was withdrawn with liberty to reapply post-charge sheet.
Advocate Sourav Singh Tomar argued that the applicant was falsely implicated and emphasized that since the charge sheet had already been filed, further custodial interrogation was unwarranted. He further submitted that the injuries mentioned in the case were simple in nature, and the applicant being a permanent resident of Guna posed no risk of absconding or tampering with evidence. Importantly, he drew a successful parallel with a co-accused, Mahendra Sahu, who had already been granted bail in a similar matter, establishing parity.
Hon’ble Justice Sunita Yadav, after hearing both parties and considering the factual matrix, allowed the bail application. The Court directed the applicant’s release upon furnishing a personal bond of ₹50,000 with two local solvent sureties. The order also imposed several compliance conditions, including cooperation during trial, restrictions on leaving the country, and mandatory monthly attendance at the local police station.
